Halle Berry Loses Bid for Equal Custody as Court Rejects Restraining Order

Two separate rulings reshape a Hollywood custody dispute.

LOS ANGELES, UNITED STATES

Oscar-winning actress Halle Berry has suffered a setback in her ongoing custody dispute with former husband Olivier Martinez after a Los Angeles judge declined to restore their previous equal parenting arrangement, leaving the French actor with primary physical custody of their 13-year-old son. However, the court simultaneously rejected Martinez’s request for a domestic violence restraining order, producing a mixed legal outcome in a case that remains unresolved.

Los Angeles Superior Court Judge Shelley L. Kaufman issued the decisions following several days of closed-door proceedings involving testimony from both parents and other witnesses. The court maintained the existing temporary custody arrangement, under which Martinez serves as the child’s primary residential parent while Berry retains limited daytime visitation without overnight stays.

The distinction between physical and legal custody is essential. Although Berry was unsuccessful in restoring the previous 50-50 physical custody arrangement, she continues to share legal custody with Martinez. Her legal representatives have also maintained that she retains decision-making authority in specified circumstances when the parents cannot reach an agreement.

The hearing followed allegations made by Martinez concerning an incident involving Berry and their son in September. The French actor sought additional legal protections and alleged that the actress had physically mistreated the child. Berry categorically denied the accusations, maintaining in court filings that she had never abused her son.

The allegations remain disputed, and the court’s refusal to extend the temporary domestic violence restraining order must not be confused with a final resolution of every factual disagreement between the parents. Likewise, maintaining the temporary custody arrangement does not independently establish that the allegations against Berry have been proven.

During the proceedings, the child provided testimony in a closed session, with the contents remaining confidential. Other testimony included information presented by individuals familiar with the family’s circumstances. The sealed nature of the evidence limits what can responsibly be concluded from publicly available accounts.

Martinez’s attorney, Patrick Baghdaserians, welcomed the decision to maintain his client’s primary physical custody, emphasizing that Berry’s request to return to equal parenting time had been denied. Berry’s attorney, Marina Beck, expressed satisfaction with the dissolution of the temporary protective order and said the actress remained focused on her family’s well-being.

The competing responses illustrate why the ruling cannot accurately be reduced to a complete victory for either party. Martinez retains the current residential arrangement, while Berry is no longer subject to the temporary restraining order. Both developments carry distinct legal consequences.

The former couple’s relationship has been subject to prolonged legal proceedings since their separation in 2015. They married in 2013, and their divorce was finalized in 2023 following years of disagreements involving custody and co-parenting responsibilities.

Their latest dispute demonstrates the complexity of family court proceedings involving children, particularly when allegations of misconduct intersect with questions about parenting arrangements. Courts must consider evidence, procedural requirements and the child’s welfare while distinguishing between temporary protective measures and longer-term custody determinations.

The case has attracted considerable media attention because of Berry’s international profile. Yet celebrity status does not change the need for caution when reporting contested allegations, especially those involving a minor whose private testimony and personal circumstances are protected by judicial confidentiality.

The present arrangement is not necessarily permanent. Further court proceedings are expected in November, when the custody situation may be reconsidered. Any subsequent modification will depend on the evidence and legal determinations made during those proceedings.

For Berry and Martinez, the immediate outcome preserves an unequal physical custody arrangement while removing a separate protective restriction. For the public, the most important distinction is that the judicial process continues and that disputed allegations should not be presented as established findings.

Beyond the Headlines, Accountability Matters.
