Halle Berry Custody Dispute Intensifies as Judge Allows Son to Testify

Abuse allegations and conflicting accounts place child’s welfare at center of legal battle.

LOS ANGELES

A Los Angeles judge has authorized the 13-year-old son of actress Halle Berry and her former husband, Olivier Martinez, to testify in proceedings involving allegations of physical abuse and a contested custody arrangement. The ruling marks a significant development in a dispute that raises questions about parental rights, judicial safeguards and the participation of minors in sensitive family litigation.

Judge Shelley Kaufman permitted the teenager to provide testimony specifically concerning Martinez’s request for a restraining order against Berry. The authorization does not constitute a finding that the allegations are true, nor does it establish responsibility for the incident under examination.

The controversy concerns an encounter at Berry’s residence on September 26. Martinez alleges that the actress physically assaulted their son, including placing her hands around his neck. He subsequently sought emergency protective measures and primary custody.

Berry has categorically denied the accusations. In court documents, the Academy Award-winning actress rejected any suggestion that she physically or emotionally abused her child. She described the encounter as playful physical interaction rather than an assault and disputed the interpretation presented by Martinez.

A temporary restraining order was granted in early October, alongside provisional changes to the custody arrangement. Martinez received temporary primary physical custody, while Berry’s contact with her son became subject to restrictions.

These measures are interim judicial decisions, not a final determination of the disputed allegations.

The question of whether the teenager should testify has become another source of disagreement between the parents.

Martinez maintains that their son should have an opportunity to describe his experience directly to the court. His legal representatives argue that hearing the child’s account is important when assessing the allegations and determining appropriate protective measures.

Berry has expressed concern about the emotional consequences of placing the teenager in the middle of an adversarial proceeding. She has also alleged that Martinez may have influenced his account, an accusation disputed by the opposing side.

The actress has pointed to statements from other individuals, including her fiancé, Van Hunt, and her adult daughter, Nahla, as part of her response to the allegations. Nahla submitted a declaration supporting her mother and disputing the characterization of Berry as an abusive parent.

Those statements form part of the competing evidence presented by the parties. Their existence does not independently resolve what occurred during the September incident.

The case illustrates a difficult consideration in family courts: ensuring that children’s accounts can be heard without unnecessarily exposing them to additional emotional strain.

Judicial decisions involving minors must account for the relevance of testimony, the circumstances in which statements are obtained and the child’s welfare. The appropriate approach depends on the evidence and procedural safeguards available in each case.

The public prominence of the parents introduces another complication. High-profile custody disputes can generate extensive media coverage even while central factual questions remain unresolved. Public allegations may circulate more rapidly than judicial findings, creating risks of premature conclusions.

Berry and Martinez, who married in 2013 and finalized their divorce in 2023, have previously experienced disagreements over custody and parenting arrangements. Their current dispute, however, concerns specific allegations that require separate judicial examination.

The court’s decision to permit limited testimony establishes a procedural opportunity for the teenager to be heard. It does not determine the credibility of either parent’s account or the ultimate outcome of the custody proceedings.

As the case continues, the essential distinction remains between accusations, denials, temporary protective measures and findings supported by judicial evidence.
